Considering the future, including what will happen to your estate and assets when you pass away can be difficult but necessary.
This is especially the case if you want to protect your wealth and minimise the amount of inheritance tax payable on your estate, ensuring that your family members stand to benefit the most.
Our expertise includes preparing for care home arrangements, estate administration and managing estates with foreign assets. With seven offices conveniently located across the East Midlands including Nottingham, Leicester and Derby, as well as home and hospital visits available, we are well-placed to help you with arranging your financial affairs.
The legislation surrounding wills, probate and trusts is not always clear. So our friendly team provides easy to understand advice that is tailored to your circumstances.
Why get a Will written?
A will is a legal document that states what will happen to your estate and assets after you pass away. This can include how you wish to share your estate and assets with family members, charities or other people or bodies. It can also include instructions on how you wish any child under 18 to be cared for.
If you don’t make a will, then your property, money, estate and assets will be shared out according to the law. This is a process known as intestacy.
This could mean that parts of your estate could be inherited by someone that you did not wish for.
Making a will can also reduce family disputes over your estate after you pass away. This is because a will is a legally binding document that states your personal intentions. Therefore making it difficult to contest unless it meets the legal grounds of appeal.
How do I make a Will?
Making a will is a very straightforward process. It is possible to create a Will yourself. However, there are certain requirements needed to ensure the document is legally binding. A Wills & Probate solicitor can ensure that these requirements are met so that your wishes and intentions are carried out.
If your estate and assets, or how you wish to divide them, are complex, then a solicitor can also help you draft a Will that achieves your wishes legally.
At Rothera Bray, we have a member of the Wills & Probate team available at each of our local Nottingham, Leicester and Derby branches.
Our solicitors can also visit you at your home or in hospital if you are unable to visit one of our offices.
