Mediation for Businesses
Mediation is a form of Alternative Dispute Resolution. It can be used to resolve a wide range of disputes.
It’s usually offered as a method once you have received independent advice from a solicitor and where both you and the other side want to find a solution to the dispute.
Mediation typically consists of an independent advisor working with both parties to reach an agreement by asking questions that help each side to understand the issues and the options available to them for settling their dispute.
Mediation is a voluntary process. However, it is encouraged by the courts and if you should end up before a judge it could weaken your position or lead to adverse cost orders if you have previously refused the option of mediation.
Why use mediation rather than court proceedings?
The process can be quicker, less stressful and more cost-effective than attending court.
Higher settlement rates.
The process allows you to explore and discuss various aspects of the dispute and all available solutions.
You maintain more control of the process, rather than a judge making all the decisions.
It can help you to retain professional relationships by being less confrontational than court proceedings.
It can result in a settlement document that is legally binding and on an equal footing to a court order.
Takes place in a private setting so the result remains confidential.

I had an excellent experience with Rothera Bray, with Sally Simpson handling my conveyancing. The whole process was managed in a highly professional and efficient manner, with all enquiries dealt with promptly and often responded to the same day with clear explanations. Every inquiry or feedback raised with the seller’s solicitor was followed through thoroughly, ensuring all legal points were properly clarified and completed without any confusion or doubt. I was guided step by step throughout the process, which made everything smooth and stress-free. Overall, a very reliable, professional, and well-organised service which I would recommend.

Marika Whiteman took over our case, and she was quick, professional, and extremely efficient. Thanks to Marika, the purchase was completed within just two weeks. I only wish she had handled the case from the beginning. I would highly recommend Marika Whiteman as a commercial solicitor.

I recently spoke with David from Rothera Bray, found him and the whole team to be very helpful and professional. Dealing with a solicitor is not something most people have to do on a day to day basis and the team made it as easy and smooth as possible. Highly recommended.

As a family, we have used Rothera Bray on legal matters on several occasions and most recently working with Talita on drafting Wills. She was professional, responded in a timely manner, communicated clearly and took on board any questions we had; we felt well supported throughout the process. Thank you Talita.
