Mental Capacity and Court of Protection
Mental capacity and the law
Mental capacity means the ability to make your own decisions.
Mental incapacity could be caused by many reasons including:
- accident
- dementia
- stroke
- medical negligence
- learning disability
- severe mental health issues
The law surrounding mental capacity can be difficult to navigate. It’s common for issues or disputes to arise when an individual has lost capacity and decisions need to be taken on their behalf. This can be a distressing situation for family members who are navigating their loved one’s ill health, and legal complexities, at the same time.
Our specialist team have experience in providing sympathetic and comprehensive support to vulnerable clients and their families. We are always happy to discuss any issues or concerns you may have which relate to you or a loved one.
Court of Protection solicitors
The Court of Protection is a specialist court that make decisions for those who lack mental capacity. The court is based in London, but cases are usually dealt with on paper without a hearing.
Court of Protection applications can be daunting and complex. We’d always recommend using a Court of Protection specialist solicitor.

Just a short note saying a big thank you for sorting out my Will plus Lasting Powers of Attorney. All handled very professionally on my behalf. Should I ever require a solicitor in the future , your company and yourself will be my first port of contact.

On a friends recommendation, contacted solicitor Andrew Hitchon. His advice on the phone was excellent and set up a meeting with us. He spent good time with us going through understanding what we wanted, explaining in detail our options and set up next meeting to conclude. Highly professional, making it smooth and easy whole process, friendly and excellent communication verbally and e mail. Excellent office staff responses when needed. We highly recommend R&B so to have great experience.

Russell Dalby, who dealt with our replacement Wills, did an excellent job of interpreting our specific requirements. He also made some very helpful suggestions that really added value for us. Would definitely recommend.

We instructed Rothera Bray for support administering my late mum’s estate through probate. We worked with Jasmin Marshall from the Mapperley office. My experience of the service she offered was overall extremely positive. Her responses were prompt, information and advice given was accurate and easy to understand. Jasmin's attitude was a lovely mix of professional, humane and humorous. I would highly recommend Rothera Bray to others and will likely use the firm again for conveyancing and will alteration work coming up.
