DVSA Investigations and Prosecutions
At Rothera Bray, our transport and regulatory lawyers have years of experience representing transport businesses and individuals undergoing regulatory investigation and prosecution by the DVSA. We are one of the few leading law firms that specialise in this niche area of law.
We provide a truly nationwide service, with clients including:
- Goods vehicle (HGV) and passenger transport (PSV) operator licence holders
- Standard national, standard international, and restricted operator licence holders
- Company directors
- Transport managers
- Professional drivers
We will work closely with you and your businesses at every stage of a DVSA investigation, including:
- Public Inquiry hearings with the Traffic Commissioner
- Inspections of your tachograph and drivers hours’ compliance
- Interviews and questioning “under caution”
- Inspections of your operating centre and maintenance records
- Roadside stops, fixed penalties and PG9s
- Criminal prosecutions at the Magistrates and Crown Court
- Document production requests
We offer free initial consultations and fixed fees. Call us today on 03456 465 465.
Our approach
Undergoing a DVSA regulatory or criminal investigation can be an extremely stressful process. In many cases it can bring to light compliance failings of which the directors of the business were wholly unaware. Fast, effective action at an early stage can have a significant positive impact on the outcome.
Our transport solicitors will work closely with you to help navigate the road transport and operator licensing regulatory regime. We understand the damaging impact a Traffic Commissioner Public Inquiry or a criminal prosecution can have on your business, your reputation and your livelihood.
Offences and infringements
Common offences and infringements that can arise from DVSA investigations include:
- Drivers’ hours and tachograph offences
- Vehicle maintenance failings and PG9s
- Failing to keep proper records
- Operating from an unauthorised operating centre
- Changing maintenance provider without informing the Traffic Commissioner
- Overloading or insecure load offences
Legal representation at every stage of the investigation
Our road transport lawyers will work closely with you throughout every stage of the investigatory process to get the best outcome possible. The typical stages of a DVSA investigation are:
Early Investigation
At the early DVSA investigation stage we will:
- Liaise directly with the DVSA Traffic or Vehicle Examiner to seek further information about the investigation and to try resolve issues
- Represent you during any interview under caution and seek prior information about the questions that will be asked
- Identify any compliance failings with your business and help you to rectify them going forward
Traffic Commissioner Public Inquiries
If compliance failings or offences come to light as a result of the investigation, the matter will usually be referred up to the Traffic Commissioner for a Public Inquiry. We will:
- Represent you and your business at your Public Inquiry hearing with the Traffic Commissioner
- Represent your professional drivers at any Driver Conduct hearings

Shelby was our solicitor for our mortgage the process was super fast, very shocked to say we was doing a right to buy. The communication was great and we was never sat wondering, all our questions was answered, she made us feel at ease with the whole process and was very kind and approachable and always went the extra mile to make sure we understood everything. We would definitely recommend Shelby to anyone who needs a kind caring professional solicitor.

Overwhelming gratitude for Sara's handling of our house buying and selling process. During what was a very stressful process with lots of setbacks in the chain, Sara was professional, efficient and friendly through it all. As first time sellers we felt we could ask any questions around the process and if the answer wasn't known she would find out for us, without any suggestion we should already know the answers. Sara was the key communicator in our house buying process, and along with her team kept the whole thing moving in the right direction. We felt prioritised and listened to. Having used Rothera Bray 8 years ago we were pleased to find the quality of service is still second to none.

I recently used Shelby Richardson from Rothera Bray solicitors for my mortgage, and I couldn't be happier with the service. She was incredibly thorough and explained everything clearly, which really helped ease my stress during the whole process. Any questions I had were answered quickly and efficiently. I felt like she really had my best interests at heart and would definitely recommend them to anyone needing a mortgage solicitor!

Carol, Gail, Steph, what a conveyancing team. They get you through all the obstacles the other side throw at you completely unnecessarily when selling a house in 2025. If you are a Landlord in 2025 selling lots of houses, expect torture and pain. Carols' team will at least make it less pain & get the completion over the line.

We had an excellent experience with Rothera Bray and specifically Carol and Gail. Their efficiency and communication were superb through our very long process (due to issues in the chain). It was great on completion day when they rang to confirm the news and it did bring a tear to my eye. Rothera Bray were good at pursuing other legal teams elsewhere and ensuring we got a fair deal and what we wanted. I would strongly recommend Rothera Bray to other prospective house buyers/sellers.

This divorce started off as a very stressful time for me, but the professional support, on a very specialised subject, provided by Rothera Bray, made all the difference... I can only describe Rebecca as my “GUARDIAN ANGEL” . At the very first telephone call I had with Rebecca, I could sense only fantastic positive vibes, that made me feel comfortable.
