Intellectual Property Disputes
As a creator, designer or inventor your intellectual property (IP) may be one of your greatest assets, so protecting your work is probably at the forefront of your business aims.
Whilst some intellectual property is automatically protected, certain forms need to be registered at the Intellectual Property Office or other appropriate body in order to be afforded protection.
When someone infringes your intellectual property rights it means they have used, copied or exploited your property without your permission. If you have found someone infringing your intellectual property rights it is important to seek legal advice early to remedy the situation as soon as possible and to prevent ongoing infringement.
Why use Rothera Bray for intellectual property disputes?
We fully understand that discovering that someone has infringed upon your IP rights can be both disappointing and frustrating. We are well-versed in dealing with intellectual property disputes and can help you in resolving your claim, receiving damages and securing your intellectual property rights for the future.
We can advise on whether your work has been infringed or you think you are responsible for infringing someone else’s designs.
We will work with you to identify your intellectual property rights and can advise on whether these rights have been exploited.
We listen to what you want to achieve from litigation and devise a strategy to meet those goals.
Where possible we will avoid your case progressing to issuing court proceedings by seeking other remedies via alternative dispute resolution.
We can advise on various methods available to resolve the matter, from injunctions and compensation to destruction or delivery up of the infringing material.
Where court proceedings are necessary we have a wealth of experience in appearing before the courts to both pursue and defend litigation.
We can act for various industries on a broad range of issues.
We can also advise you on protecting your intellectual property online.
We can help you with:
- Trademark infringements
- Copyright infringements
- Patent infringements
- Registered design infringements

Emma Adcock was absolutely superb during my divorce and subsequently during a prolonged and difficult house sale in which she endeavoured to get the right and just outcome for me. I would never use any other solicitor or solicitors firm for any legal challenges that may come along in the future. I cannot say enough great things about Emma or the firm Rothera Bray. Thank you so much.

Both Grace and Ellie from the Derby team have been absolutely incredible, they’ve kept me updated at every stage of the conveyancing process and have been so thorough. They’ve both been on hand to answer any questions I’ve had throughout and have worked so hard to get us so close to completion in impeccable timing. They’ve made the whole process as stress free as possible and I couldn’t recommend them high enough. Such an amazing team. Thanks so much Grace and Ellie.

I've had business with Rothera Bray over the years for conveyancing, probate, wills and LPA; thank you to Sarah Soo and others in the teams. All have been excellent experiences. The most recent business, with Ed Granger of their trust department, was up to their usual 5 star standard. Of note is the care taken to highlight any potential issues and the processes to be followed subsequently, not forgetting the timely responses to queries.

We recently instructed Abbey Freeman at Rothera Bray to act as our conveyancer when moving house, and I honestly can’t recommend her highly enough. She was efficient, knowledgeable, and always quick to respond to any questions. Her attention to detail and calm approach made the whole process far less stressful than expected. Her paralegal Luisa was also absolutely brilliant, knowledgeable and approachable. Excellent service from start to finish. Thank you Abbey and Luisa!

We had a good experience with Rothera Bray. They helped us to update our Wills. They explained all the available options in a clear, understandable and patient manner and included diagrams to give a pictorial explanation. They also gave us scenarios for the options to enable us to see the pros and cons for each option and to help us decide which options would best suit our current needs. We would recommend Rothera Bray for clear, professional, legal advice.
