International Probate
If you own assets in more than one country it can be complex and time-consuming to administer your estate. The help of someone experienced in dealing with probate involving international aspects is essential.
In some cases probate – which is the process of administering the estate – needs to be obtained in all the countries where assets are located, or a UK Grant of Representation needs be resealed in the relevant jurisdiction.
It’s also important to be aware that some countries do not recognise UK processes such as estate administration. Their laws may take other factors into consideration when deciding how the estate should be distributed. This can make the process of dealing with the estate even more complicated.
We have a dedicated members of our Wills, Probate and Trusts team who specialise in dealing with estates with foreign assets. We can manage all aspects of the UK estate, for example:
- getting a Grant of Probate
- organising and collecting property
- paying inheritance tax
- passing on inheritance
- liaising with experts in other relevant jurisdictions regarding international assets and taxes
Why use Rothera Bray for international probate?
Our experienced specialist team will guide you through international probate.
We can:
- deal with a range of cases, from straightforward assets to complex, high-value estates with trusts
- advise on estates where the deceased was a UK national with assets abroad or a foreign national with UK assets.
- communicate internationally: we have team members fluent in different languages, including Afrikaans, Dutch, Italian, Portuguese and Spanish
- work with lawyers based abroad to help them apply for a UK Grant of Probate, or reseal a foreign Grant of Probate in the UK
- advise you on tax and trust services in the UK and refer you to advisors in different jurisdictions, as needed
- advise on heritage properties, international trusts and international wealth management structures
- work with international lawyers, real estate agents, tax planners and courts
- advise on the implications of an including or excluding international assets in a UK Will, and when we’d recommend drafting a Will in a different jurisdiction if you have assets abroad
- engage agents to help with tracing assets and beneficiaries abroad
- advise on tax matters including income tax, inheritance tax and capital gains tax in the UK. We can also guide you on how these are impacted by foreign residence or double taxation.

We cannot thank Rothera Bray enough for the outstanding support they provided throughout our Special Guardianship Order (SGO) process. Thanks to their expertise, professionalism, and dedication, we achieved a successful outcome, and we genuinely couldn't have done it without them. A special thank you goes to Ann-Marie and Emily, who guided us every step of the way. They were always there to offer advice, reassurance, and practical support whenever we needed it. No question was ever too much trouble, and they responded to any concerns or issues incredibly quickly, giving us confidence throughout what was a very challenging and emotional process. Their professionalism, knowledge, and attention to detail are of the highest standard. They made us feel supported from start to finish and always had our best interests at heart. We are truly grateful for everything they have done for our family and would wholeheartedly recommend Rothera Bray to anyone in need of exceptional legal representation. Thank you again, Ann-Marie and Emily, for making such a positive difference to our lives.

We were extremely satisfied with the service from Rothera Bray during the process of rewriting our Wills and Side letters. Our Wills are complex and our solicitor clarified the necessary changes and took the time needed to ensure we understood the legalities involved. The service was professional but friendly.

I found Rothera Bray to be professional and responsive. I was glad I used a firm with a local office rather than one of the remote conveyancing companies.

We had the pleasure of dealing with Rothera Bray for our property purchase and specifically Tim Brooke and his team Craig Allsopp and Nikola Dzierzak. Despite a non-straightforward transaction with multiple titles, Tim and his team were excellent from start to finish, always advising us in a timely manner and doing a really thorough job on all the searches and relevant property matters. Once completion took place, Tim and team stayed engaged to ensure the title registration was complete despite the delays at land registry. We cannot thank Tim enough as at several points we thought the property deal might fall through but with the advice, guidance and attention to detail provided by Tim we got there in the end! Thank you.

Thank you to everyone for all your help over a long period of time. Your mannerism and efficiency to solve each issue was most impressive. I have recommended your services to others .What was going on in the background certainly tested my patience and you kept the ship running smoothly.

Marriage is an important milestone, but it can also bring significant legal and financial implications. Without careful planning, a relationship breakdown could affect both personal finances, and the viability of the farm itself.
