Can I make a no win no fee personal injury claim?
A ‘no win, no fee’ claim is also known as a conditional fee agreement. This type of agreement reduces the risk to you because there are no fees to pay upfront and if your case is not successful, you do not have to pay any legal fees, as long as you have co-operated with us and have not misled us. As a result, you can focus on your recovery, without worrying about legal fees.
Success fee
If we can act on a ‘no win, no fee’ basis and your case is successful, you will pay a contribution towards your legal fees. You will pay what is called a success fee. This is based on a 100% uplift on your basic legal costs, capped at 25% of the value of your claim for pain and suffering and past losses. We cannot say exactly how much the success fee will be, as this depends on the final value of your claim and how much work is involved in your case.
However, please rest assured that the success fee cannot be any more than 25% of your compensation. If you lose your claim, then of course you do not pay a success fee.
Insurance
Whilst acting on a ‘no win, no fee’ basis, we may, either at the start or as your case progresses, advise you to instruct us to put in place a policy of After The Event Insurance (ATEI).
This policy will protect you from paying any of your own disbursements, such as medical report fees and court fees and any costs incurred by the other party if you lose your claim. If you win your claim, this ATEI premium is deducted from your damages. If you lose your claim, you do not pay the premium.
Alternative funding
In most circumstances, we act on a ‘no win, no fee’ basis.
If your claim cannot be dealt with on a ‘no win, no fee’ basis, we will let you know before the claims process starts. Alternative funding options are sometimes available, such as Trade Union Membership and Legal Expenses Insurance, which is often included on household insurance policies.

We had the pleasure of dealing with Rothera Bray for our property purchase and specifically Tim Brooke and his team Craig Allsopp and Nikola Dzierzak. Despite a non-straightforward transaction with multiple titles, Tim and his team were excellent from start to finish, always advising us in a timely manner and doing a really thorough job on all the searches and relevant property matters. Once completion took place, Tim and team stayed engaged to ensure the title registration was complete despite the delays at land registry. We were facing a highly stressful motoring matter involving a Section 172 allegation alongside a speeding offence, which originally arose because we never received the initial NIP / request to provide driver details in the post.
