Being caught driving under the influence of drugs is a very serious offence and could result in a custodial sentence, yet it is an offence that can easily be committed unknowingly, especially if it was caused as a result of consuming legal or medicinal drugs.

As of 2015 a new drug driving offence was introduced which made it possible to be prosecuted for driving whilst unfit through drugs and driving with excess drugs. This offence includes legal limits for both certain legal prescription drugs often used and illegal drugs.

If you are pulled over by the police because they suspect you of drug driving you may be asked to undergo a Field Impairment Test to determine whether or not you are fit to drive. If you are considered to have failed this test then you will need to attend a police station for a blood test.

If you are convicted of drug driving you will face a driving ban of at least 12 months, a criminal record and a maximum fine of £5000.

At Rothera Bray our motorist defence team are aware of the repercussions you may face for drug driving allegations. We will discuss the allegation in detail with you, including reviewing the strength of the prosecution’s case against you to decide on the most successful strategies to use for a successful defence.
