Mental Capacity and Court of Protection
Mental capacity and the law
Mental capacity means the ability to make your own decisions.
Mental incapacity could be caused by many reasons including:
- accident
- dementia
- stroke
- medical negligence
- learning disability
- severe mental health issues
The law surrounding mental capacity can be difficult to navigate. It’s common for issues or disputes to arise when an individual has lost capacity and decisions need to be taken on their behalf. This can be a distressing situation for family members who are navigating their loved one’s ill health, and legal complexities, at the same time.
Our specialist team have experience in providing sympathetic and comprehensive support to vulnerable clients and their families. We are always happy to discuss any issues or concerns you may have which relate to you or a loved one.
Court of Protection solicitors
The Court of Protection is a specialist court that make decisions for those who lack mental capacity. The court is based in London, but cases are usually dealt with on paper without a hearing.
Court of Protection applications can be daunting and complex. We’d always recommend using a Court of Protection specialist solicitor.

We had an excellent experience working with Amelia. She helped us with setting up trusts for our properties, gifting a property, and preparing our wills, all handled with great professionalism and clarity. Everything was completed to a tight deadline and Amelia ensured the process ran smoothly from start to finish. She also linked us with an accountant and arranged the necessary documentation for related activities and ongoing financial management, which made everything seamless and stress-free. We felt well supported throughout and would highly recommend Amelia’s services.

We asked Rothera Bray Solicitors - West Bridgford to write our wills and received excellent service and guidance from Talita Fantauzzi. She was professional and friendly in delivering the advice we needed. We would definitely recommend Rothera Bray Solicitors and would use them for any future legal advice and work we may require.

Rothera Bray was tasked with sorting my late Mother’s estate. We were fortunate to have Nelissa as our Solicitor. She was not only professional and compassionate, but always went the extra mile to ensure resolutions at every opportunity. I cannot recommend Nelissa enough and will not hesitate to use her again in the future.

Having previously used one of the legacy solicitor firms we returned to the now enlarged Rothera Bray for preparing our Wills and LPAs. As before, the service was both professional and efficient whilst retaining its local feel and knowledge.

I received support from Laura to register an Enduring Power of Attorney that had been set up many years ago. Laura was knowledgeable, clearly explained the steps we had to go through and the cost. She was kind and patient with my mum who has dementia and was proactive in progressing the activity. I would definitely recommend working with her.
