How our Leicester legal team can you buy or sell a house
FAQs
Conveyancing refers to the legal procedure involved in transferring ownership of a property from the seller to the buyer. This process begins when the buyer’s offer is accepted and continues until the sale is finalised.
If you buy a freehold, you own the property as well as the land that the property sits on. You will be responsible for covering the cost of any repairs or damage to the property.
If you buy a leasehold, you do not own the land but purchase the right to occupy the building for a set number of years (usually between 125 and 999 years). You won’t be responsible for shared spaces but will have to pay a service charge and ground rent to cover maintenance costs.
If you’re a first-time buyer you’ll need a minimum 5% deposit, however most banks prefer buyers to have a 10% deposit, which will also give you more mortgage options and lower interest rates.
It can take on average 8-12 weeks to buy or sell a house, but the time can vary depending on several factors including:
- The length of the chain
- Delays in receiving responses or documents from other parties
- Delays in surveys/searches
- Not signing or returning documents on time
- Mistakes on mortgage application forms
- Expired mortgage offer
- Time taken obtaining title deeds if they are not on the Land Registry’s digital register
- A party pulling out of the chain
Our Leicestershire conveyancers will help you avoid these delays.
