What is a Supervision Order?

A Supervision Order is usually put in place after a local authority has expressed concerns about the welfare of a child and launched a section 47 enquiry and pre-proceedings meeting with the parents or guardian. An order may be put in place if the parents or guardian agree to cooperate with social services and implement measures that will make sure the child is safe and well cared for.

A Supervision Order gives the local authority the ability to monitor a child within the family home and an ability to provide support to the child.

A Supervision Order must be applied for through the court by the local authority, and can only be granted if: it is believed that the child is in harm or is at risk of harm in the future; the child’s parents are causing that harm; or the parents are unable to control the child and consequently cannot protect the child from harm.

At Rothera Bray our experienced child care team are well-versed in helping parents or guardians where an application for a Supervision Order has been made or where a Supervision Order has already been made. We would suggest seeking legal advice early, especially if you want to appeal against the Supervision Order. We can guide you through the whole process including collating and preparing any documents required and representing you at court where necessary.

Why use Rothera Bray where a Supervision Order has been granted?

We can advise parents or guardians on what steps to take if a Supervision Order is applied for or has been granted.

We can advise on whether or not it is appropriate for you to apply to discharge a Supervision Order, including how to prepare an application to the court.

We can offer Legal Aid if eligible.

We can advise you if the local authority has applied for any further orders such as a Care Order or Emergency Protection Order.

We have seven offices across Nottingham, Leicester and Derby all providing family law and child care advice.
